Policy Statement Unauthorised Advertising on Public Roads

It is the policy of the Council to endeavour to ensure that the public road is kept clear of unauthorised advertisement signs in accordance with Section 71 of the Roads Act 1993.

Under Section 71 of the Roads Act 1993, the Council can remove any unauthorised signs or vehicles, notify the owner and impose a charge on the owner of the amount of expenditure reasonably incurred in removing and storing it.

Donegal County Council have it in their power to remove the vehicles to a storage area and charge the cost incurred in removal and storage on the person reclaiming the sign or vehicle.

This policy has been implemented with regard to advertising signs but to date no vehicles have been removed. It has been found that the owners of the vehicles have removed them when advised of the vehicles imminent removal by the Council. The matter is kept under constant review and the Council may have to use their powers and actually remove vehicles along the public road that are advertised for sale.
