1995 Tenant Purchase Scheme for Purchase of Local Authority Dwellings

A tenant can apply to purchase their Local Authority House under this Scheme if they have at least 12 months tenancy. Most Local Authority houses can be bought with the exception of 1 bedroom houses and 2 bedroom houses which are let to tenants who are 55 years of age or over on the date of commencement of tenancy. The price of the house will be its market value, as determined by the local authority, in its existing state of repair and conditions less any discounts. The structural condition of the house will be taken into account and any increase in the market value, due to the improvements made by the tenant will be disregarded in calculating the price. A discount of 3% of the market value of the house is given for each year of the reckonable period of tenancy, subject to a maximum of 30%, plus €3810.

Building Energy Rating (BER) Certificate

Building Energy Rating Certificates must be issued in respect of all dwellings offered for sale from 1st January 2009. This Certificate gives an objective scale of comparison for the energy performance of the dwelling ranging from A1 to G with A1 representing the most energy efficient, and G representing the least energy efficient. The dwelling is valued having regard to the BER Certificate and the Council are under no obligation to carry out any improvement to the energy performance of the dwelling.

Offer Letter

The Local Authority issues an offer letter stating the purchase price. The tenant has 1 year in which to accept this offer and the full purchase monies must be paid within 1 year from the acceptance of the offer.

Mortgage

If the tenant is unsuccessful in obtaining a mortgage from both a Building Society and a Bank they may apply to this Council for a mortgage.
