Background Notes

At the adjourned meeting of Donegal County Council on 13^th December 2017 and in accordance with section 12(5) of the Planning & Development Act 2000 (as amended), the Members of Donegal County Council considered the Draft Plan and the Chief Executive’s Section 12(4) Report on submissions or observations made during the public consultation process, and decided to amend the Draft Plan. The amendments include a total of 40 proposed Material Alterations.

Pursuant to section 12(7)(aa) of the Planning & Development Act 2000 (as amended), the Planning Authority determined that a Strategic Environmental Assessment (SEA) and Appropriate Assessment (AA) were required to be carried out as respects a number of specified proposed Material Alterations. In addition, and pursuant to Section 12(7)(ab) of the Planning and Development Act 2000 (as amended), a period of 7 weeks was specified as being required to facilitate the aforementioned assessments after which time the proposed Material Alterations would be made available for inspection and consultation, and submissions and observations invited.
