COMPULSORY ACQUISITION OF LAND
DONEGAL COUNTY COUNCIL (N15 LOUGH MOURNE ROAD SAFETY IMPROVEMENT SCHEME) COMPULSORY PURCHASE ORDER, 2023
Donegal County Council (hereinafter referred to as “the local authority”) in exercise of the powers conferred upon them by section 76 of the Housing Act, 1966, and the Third Schedule thereto, as extended by section 10 of the Local Government (No. 2) Act, 1960 (as substituted by section 86 of the Housing Act, 1966 and as amended by section 6 and the Second Schedule to the Roads Act, 1993 and as amended by the Planning and Development Acts, 2000 – 2022, have made an order entitled as above which is about to be submitted to An Bord Pleanála for confirmation. If confirmed, the order will authorise the local authority to acquire compulsorily and permanently the land described in Parts I and II of the Schedule hereto (“the Schedule”) and compulsorily and temporarily the land described in Part III of the Schedule for the purposes of a proposed road development consisting of completion of road cross section of the N15 at Cashelnavean, Ballybofey together with associated amenities (known as the “N15 Lough Mourne Road Safety Improvement Scheme”).
Owners, lessees and occupiers of the land described in the Schedule will receive individual written notice. Prior to a decision on confirmation or otherwise of a compulsory purchase order An Bord Pleanala may at its absolute discretion hold an oral hearing in relation to the matter. A copy of the order and of the map referred to in it may be seen at all reasonable hours (9am -12:30pm and 1pm to 4:30pm Monday to Friday) at:
(a) The offices of the Local Authority, County House, Lifford F93 Y622.
(b) The offices of the Local Authority, Public Services Centre, Drumlonagher, Donegal Town F94 DK6C.
